Privacy Policy Confidentiality Code

The Script Archeologist.com (created and run by Progeny Designs) provides script analysis & related consulting services to our users. We are committed to protecting the safety and security of all our online visitors. We remain sensitive to our user's concerns regarding the safety of their personal information provided to us. All our users need to read this Privacy Statement carefully in order to understand how any personal information collected about you is used.

 

1. Definitions: Parties "Disclosing Party" - the party disclosing the Confidential Information to the other. "Recipient Party" - the party receiving Confidential Information from the other. 2. Undertakings of the Recipient: In consideration of the Disclosing Party disclosing Confidential Information to the Recipient Party, the Recipient Party undertakes to: 2.1 keep Confidential Information that it may acquire during dealings between the two parties; 2.2 permit access to all Confidential Information only to its agents or employees as have a strict need to know such Confidential Information and inform each of them of the confidential nature of the Confidential Information and of the Recipient's obligation under this Privacy Policy Confidentiality Code; 2.3 make copies of the Confidential Information only for its agents or employees that have a strict need to know; 2.4 keep the existence, nature, and content of this Privacy Policy Confidentiality Code confidential; 2.5 on request of the Disclosing Party, made at any time, deliver to the Disclosing Party or destroy all documents and other material in the possession, custody or control of the Recipient that bear or incorporate any part of the Confidential Information; 3. Exceptions: The Recipient Party shall not be bound by the provisions contained in Clause 2 above if such Confidential Information: 3.1 was already in the lawful possession of the Recipient Party and at its free disposal before the disclosure by the Disclosing Party to the Recipient Party; 3.2 is lawfully disclosed to the Recipient Party without any obligations of confidence by a third party; 3.3 is or becomes generally available to the public in printed publications in general circulation through no act or default on the part of the Recipient Party or its agents or employees; 3.4 is replicated by development independently carried out by or for it by an employee or other person without access to or knowledge of the Confidential Information; 3.5 is required to be disclosed by a government or regulatory body or court of comparable and competent jurisdiction; 3.6 is generally made available to third parties by the Disclosing Party without restriction on disclosure. 4. Scope: Neither this Privacy Policy Confidentiality Code, nor the disclosure or receipt of Confidential Information shall constitute or imply any promise or intention or commitment by either party or their respective affiliated companies, organizations or other to: a) procure any product or service; or, b) make any commitment with respect to the present or future marketing of any product or service; or, c) enter into a contract with the other party; or, d) grant a license of any intellectual property right; e) make any representation, warranty, assurance, guarantee, or inducement of any kind. 5. Law and Jurisdiction: This Code shall be governed by and construed in all respects in accordance with the Laws of Canada, and each party submits to the exclusive jurisdiction of the Canadian Courts. Neither party has any obligation to disclose Confidential Information to the other. Either party may, at any time: (A) cease giving Confidential Information to the other party without any liability, and/or (B) request in writing the return of Confidential Information previously disclosed. Either party may terminate this arrangement at any time without cause upon written notice, by recorded mail, to the other party. All obligations of confidentiality will survive termination of this arrangement. In the event that this arrangement is terminated, and the Disclosing Party so requests in writing, by recorded mail, the Recipient Party will promptly return or destroy (and certify destruction of) all Confidential Information which it received from the Disclosing Party along with all copies which it made. 6. Survival: This arrangement shall survive and continue and shall not merge with any subsequent agreement between the parties. Declared for and on behalf of the Recipient Party (The Script Archeologist, of 1262 Wessex Place, Regina, Saskatchewan) by Ken Whittal, its owner. Dated 25th August 2007 and effective as at the current date. This is declaration of a Privacy Policy Confidentiality Code for the information of prospective clients and does not constitute a legal or binding Contract. It is subject to periodic revision. The Script Archeologist is always willing to sign a properly drawn up Confidentiality Agreement worded according to the above Privacy Policy Confidentiality Code.

Online Promotions:
We or our advertisers, licensees and/or other business partners may have special online promotions which feature products or services related to our business activities. TO PARTICIPATE IN ANY PROMOTION, YOU MUST BE 18 YEARS OR OLDER. You may be asked to provide an e-mail address and name, so that we can let you know if you have won a prize. For other promotions, we may request your name and home address in order to send you products or information by regular mail. The specific rules and regulations governing the particular promotion will vary and your participation constitutes your agreement to abide by those rules and regulations. Certain of these promotions may be co-branded with one of our partners. For example, we may have an online promotion to participate in a product offer branded with one of our brands (e.g. The Quest for the Golden Script). The collection of your personally identifiable information may occur directly by our third party partner on their Web site. The promotion will state the privacy policy or policies governing the collection of such information.

Online Contests and Sweepstakes:
We or our advertisers, licensees and/or other business partners may sponsor contests or sweepstakes, which may be entered online. The specific rules and regulations governing the particular contest or sweepstakes, including the applicable privacy policy, will vary and your participation constitutes your agreement to abide by those rules and regulations.

Collecting and Sharing Data:

What We WILL NOT DO With Your Personal Information

The following outlines the ways we share your information. We do not share your personally identifiable information in ways other than as described in this Privacy Policy. We sometimes collect information to find out how people found our Web site, which pages they visited, and how long they stayed. The Script Archeologist does not disclose any personal information except to those that help it provide technical, administrative and data processing services (including hosting, billing, affiliate tracking, fulfillment, and data storage and security) "Affiliated Parties". The Affiliated Parties to whom The Script Archeologist discloses your personal information all have agreed to abide by this Privacy Policy. Some of these Affiliated Parties have separate privacy policies that govern their collection, use and storage of information that you provide to them directly. Example: Paypal's own privacy policy for customers using their services. We also use third party service providers to assist in our service offerings. Such providers may include a credit card processing company, an outside shipping agent to fulfill delivery of orders, and an email service provider to facilitate our e-mailings. We will share your personal information with these types of third parties to facilitate functions on our behalf. These companies limit their use of your personally identifiable information to fulfilling their services to us. In some instances, such as when making a purchase, you may be directed to the service providers Web site to conduct the transaction by entering in your personally identifiable information. Although these pages may have the look and feel of The Script Archeologist Online Web sites, you are actually submitting your information directly to that service provider to fulfill your request. Our clients support the Script Archeologist. The Script Archeologist does not sell or knowingly divulge your information to any non-Affiliated Parties, unless we are required to share your information with a third party in order to comply with law, to comply with a court order or subpoena, to enforce our site or promotion rules or to protect the safety and security of our users and our Web sites.

What We WILL DO With Your Personal Information

Where appropriate and if you are 18 or older, the option to allow us to share certain information with some of our promotional partners may be provided, or the option for you to elect not to have us share certain information may be provided. You always have the right to unsubscribe from any mailing lists we may maintain.

We may offer fully interactive registered email services. We also provide exciting & informative newsletters, such as The SCRIPT DIG LETTER Newsletter to tell our users about interesting films, licensed products and services. Our newsletters may include links to independently operated Web sites. Please be aware that we don't control and are not responsible for their actions, privacy policy(ies) or terms of use.

Forums/Blogs/Bulletin Boards/Chat Rooms:
The Script Archeologist's forum The Script Dig is a place for writers, industry specialists and interested parties to interact by posting messages. The forum must be signed up for separately from the services we supply and is subject to TERMS OF USE. If you use a forum or Blog on this site, you need to be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these activities or forums.

Purchasing Items:
Purchasing items from our online SWAG store requires the giving of personally identifiable information (such as, name, credit card information). Information collected in this manner will be used consistent with this Privacy Policy. Security and Credit Card Use The Script Archeologist does not process your payments directly. Instead we contract this service to PayPal. PayPal Founded in 1998, PayPal, an eBay Company, enables any individual or business with an email address to securely, easily and quickly send and receive payments online. Links:
We do present links to the Web sites of other parties. Independently operated Web sites are not associated with or authorized by us, even if they have links leading to this Web site. We are not responsible for any content appearing on Web sites linked to or from our Web site, or for any personal information gathered at those independently operated Web sites.

Squeeze Pages:
We sometimes provide a "squeeze page" when linking from our Web site to an independently-operated Web site, which lets you know you are going to an independently-operated Web site.

International Visitors and Customers:
This Web site is hosted in the United States on Lunarpages Web Hosting. To What Web sites does this Privacy Policy Apply?
The terms of this Privacy Policy apply to all information submitted on the following Web sites: www.thescriptarcheologist.com and www.progenydesigns.com and not to information that may be submitted to us offline. In addition, the terms shall only apply to Web sites owned and operated by Progeny Designs, or any of its affiliated, subsidiary or related corporate entities, as well as to some of our selected corporate partners and licensees who have agreed to abide by our Privacy Policy.

It does not otherwise apply to any independently operated Web sites, for which separate privacy policies and terms of use shall apply. Finally, since this Privacy Policy is intended to protect individuals.
